Terms & Conditions

These Terms & Conditions govern the use of this website and all services provided by The Stump Father, LLC, a Wisconsin Limited Liability Company (“Company,” “we,” “us,” or “our”). By using this website or engaging our services, you agree to the following terms.

1. Company Status & Insurance

The Stump Father, LLC is a legally organized and operating Limited Liability Company in the State of Wisconsin.

We maintain commercial general liability insurance applicable to the services we perform. Proof of insurance is available upon written request.

Nothing in these Terms shall be construed as expanding liability beyond the limits of our insurance coverage or applicable law.

2. Scope of Work

All services are limited strictly to the scope described in the written estimate or invoice.

Services may include, but are not limited to:

  • Tree removal

  • Stump grinding

  • Yard restoration

  • Brush and debris removal

  • Equipment access across the property

Any additional work not expressly included in the written agreement will require written approval and may result in additional charges.

Verbal modifications are not binding.

3. Estimates & Unforeseen Conditions

Estimates are based on visible and reasonably observable site conditions at the time of inspection.

The following are considered unforeseen conditions and may require price adjustments:

  • Hidden root systems

  • Buried concrete, metal, wire, rocks, or debris

  • Underground utilities or irrigation systems

  • Septic systems or drain fields

  • Hardscape encroachments

  • Inaccessible terrain or restricted equipment access

If unforeseen conditions are discovered, work may pause until revised pricing is approved.

4. Underground Utilities & Marking Responsibility

The property owner is solely responsible for:

  • Identifying and marking private utilities

  • Notifying us of sprinkler systems, invisible fences, drain tiles, septic systems, underground wiring, or other subsurface structures

  • Ensuring utilities are properly located prior to work

While reasonable care is exercised, The Stump Father, LLC is not responsible for damage to unmarked or improperly identified underground systems.

5. Property Damage & Site Conditions

Tree work and stump grinding involve heavy machinery and inherent risks.

Customer acknowledges and accepts:

  • Surface disturbance is expected during stump grinding

  • Soil settling may occur after restoration

  • Minor lawn rutting or turf damage may result from equipment access

  • Wood chips and debris may remain unless removal is specified

  • Weather conditions may impact final grading results

The Company shall not be liable for:

  • Pre-existing property defects

  • Structural instability of trees

  • Damage caused by decay, rot, hollow trunks, or storm-weakened trees

  • Acts of God, including wind shifts during removal

  • ​

6. Limitation of Liability

To the fullest extent permitted by Wisconsin law:

  • Our liability is strictly limited to the amount paid for the services performed.

  • We are not liable for indirect, incidental, consequential, or punitive damages.

  • We are not responsible for loss of use, diminished property value, or landscaping replacement beyond the agreed scope.

No claim shall exceed the total contract amount.

7. Payment Terms

Payment terms are outlined in the written estimate or invoice.

Unless otherwise stated:

  • Payment is due upon completion unless agreed upon prior to starting of work

  • Late payments may incur interest at the maximum rate permitted by law.

  • The Company reserves the right to file a construction lien as permitted under Wisconsin statutes for unpaid balances.

Customer agrees to pay all reasonable collection costs, including attorney’s fees.

8. Scheduling & Delays

All projected timelines are estimates only.

Delays may occur due to:

  • Weather conditions

  • Equipment repair or maintenance

  • Emergency service calls

  • Safety concerns

The Company shall not be liable for scheduling delays beyond its control.

9. Indemnification

Customer agrees to indemnify and hold harmless The Stump Father, LLC from any claims arising from:

  • Failure to disclose underground hazards

  • Failure to secure pets or personal property

  • Third-party interference during service

  • Misrepresentation of property boundaries

  • Service availability

  • Exact pricing

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wisconsin.

Any dispute shall be resolved in a court of competent jurisdiction located in Wisconsin.

Customer agrees to attempt good-faith resolution prior to litigation.

12. Severability

If any portion of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.
